Welcome to Uvvar, we are delighted to have you as part of the Uvvar business community. Thank you for choosing to use our services, but be sure to follow the company rules.

 

  Here are the Uvvar.com Terms of Service.

We have listed below important legal terms that apply to every visitor to our website and every user of our services. These conditions are necessary for your protection and ours, in order to be able to provide our services in a manner satisfactory to everyone. Uvvar offers a wide range of services and features and some of these terms may not apply to the particular services you use.

 

1. Acceptance of these Terms

This document and the other documents we refer to below constitute the Company Rules, or what we formally refer to as our Terms of Service (the “Terms” for short).

The Terms form a legally binding contract between you and Uvvar.

Note that  Section 11. Disputes with Uvvar , contains an arbitration clause and a class action waiver. By agreeing to these Terms, you agree to resolve all Disputes through binding individual arbitration, which means that you waive any right to have such Disputes resolved by a judge or jury, and to your right to participate in a class action, class arbitrations or representative actions.

This contract establishes your rights and responsibilities during your use of Uvvar.com,  our mobile applications and other services provided by Uvvar (we will collectively refer to these as “  Services  ”), so read it carefully. By using any of our Services (even just browsing one of our websites), you agree to these Terms. If you do not agree to abide by the Terms, you may not use our Services. You always follow us  ? 2. Those other documents we mentioned

Uvvar's Services connect people all over the world, both online and offline, to create, deliver, sell and buy unique goods. Here's a handy guide to help you understand the rules specific to you, depending on how you use the Services  :

Our company rules for everyone. By using any of our Services, you signify your agreement to these Terms, our  Privacy Policy.

Our Buyer Rules . If you use our Services to browse the site or make purchases, these rules apply to you.

All of these policies are part of our Terms, so be sure to read the ones that apply to you. Of course, you still need to read the rest of this document because it applies to everyone.  !

3. Your personal information

We know you care about your personal information, so we care about it too. Our  Privacy Policy  details how your information is processed when you use our Services. By using our services, you also agree to let us process that information in the ways set out in these Rules. Read it too.

Our members' personal information (e.g., buyer's name, email address, and shipping address) is processed by both Uvvar and Sellers, and are therefore considered, in accordance with the European Union law, as separate and independent data controllers for buyers' personal information. This means that each party is responsible for the personal information it processes in connection with the Services provided. If, for example, a seller accidentally discloses a buyer's name and email address while processing another buyer's order, the seller, not Uvvar, is responsible for the unauthorized disclosure. 

However, if Uvvar and the sellers are considered joint data controllers for a buyer's personal information, and if Uvvar is sued, fined, or required to pay costs as a result of action by you as As joint data controller, you agree to indemnify Uvvar for expenses incurred by your processing of a buyer's personal information. Consult the  Section 9. Compensation (or what happens if we are sued as a result of an action by you)  below for more information regarding your indemnification obligations to Uvvar.

4. Your Uvvar account

You must create an account on Uvvar to use some of our Services. Here are some rules about Uvvar accounts  :

A. You must be 18 or older to use our Services.  Minors under the age of 18 and 13 or older are permitted to use Uvvar's services only through an account belonging to a parent or legal guardian and if they have their authorization and are under their control. direct supervision. Children under the age of 13 are not permitted to use Uvvar or its Services. You are responsible for any activity performed by a minor on your account. To find out more, see the  Regulations concerning minors  from Uvvar.

B. Be honest with us.  Provide accurate information about yourself. Using false information or impersonating another person or company through your account is prohibited.

Choose an appropriate name.  If you choose not to use your full name as the name associated with your account, you may not use language that is offensive, vulgar, violates someone else's intellectual property rights, or violates these Terms of Service. another way.

D. You are responsible for your account.  You are solely responsible for all activity on your account. If you share your account with others, the person whose financial information is listed on the account will have final responsibility for all activities. If you are registered as a business, you personally warrant that you are authorized to agree to abide by the Terms on behalf of the business. Also, your accounts are not transferable.

E. Protect your password.  As mentioned above, you are solely responsible for all activity on your account, so it is important to keep your account password secure. 

  F. Let's be clear about our relationship.  These Terms do not create any agency, partnership, joint venture, employment or franchise relationship between you and Uvvar.

 

5. Your Content

Content that you post using our Services is your content (it will therefore be referred to as "  Your Content  "). We do not claim ownership of this Content, which includes anything you post using our Services (such as store or service names, profile pictures, listing photos, listing descriptions, reviews, comments, videos, usernames, etc.).

A. Responsibility for Your Content.  You understand that you are solely responsible for Your Content. You represent that you have all necessary rights with respect to your Content and that you do not infringe or violate the rights of third parties by posting it.

B. Permission to Use Your Content. By posting Your Content through our Services, you grant Uvvar a license to use it. We do not claim ownership of Your Content, but we do have permission to use it to help Uvvar operate and grow. In this way, we will not violate any rights that you have vis-à-vis Your Content and we can help promote it. For example, you acknowledge and agree that, from time to time, Uvvar may offer you or Uvvar buyers promotions on the Site in connection with your listings.

C. Rights You Grant to Uvvar.  (Here is the legal language version of the last article). By posting your Content, you grant Uvvar a non-exclusive, worldwide, royalty-free, irrevocable, assignable, perpetual license to use, display, publish, modify, reproduce, distribute, store, and prepare derivative works of your Content. This enables us to provide the Services and promote Uvvar, your Uvvar store, or the Services generally, in any format and through any channel, including through any Uvvar Services, our partners , third-party websites or advertising media. You agree not to exercise any moral right or right of  advertising against us for the use of such Content. You also acknowledge our legitimate interest in using it, in accordance with the scope of this license, insofar as it contains personal information.

Sounds like a lot, but we need it to keep Uvvar running. Consider these examples  : if you upload a photo of a product sheet on your store  Uvvar, we have permission to display it for buyers, and we can resize it to catch the eye of a buyer using our mobile app  ; if you publish a description in English, we can translate it into French so that a Parisian buyer can discover the story of your article  ; and if you post a gorgeous photo of your latest handmade necklace, we can feature it on our homepage, one of our blogs, or even on a billboard to help promote your business and Uvvar.

D. Reporting Unauthorized Content.  Uvvar has great respect for intellectual property rights, and is committed to following proper legal procedures to  remove illegal content from the Services. If content that you own or have rights to has been posted on the Services without your permission and you wish to remove it, please follow the steps in our  Rules concerning intellectual property . If your content is alleged to infringe another person's intellectual property, we will take appropriate action, such as disabling it if we receive sufficient notice, or closing your account in the event of repeated infringements. If so, we will let you know.

E. Inappropriate, False or Misleading Content.  It's common sense, but there are certain types of content that we don't want to post on the Uvvar Services (for legal or other reasons). You agree not to post any content that is abusive, threatening, defamatory, obscene, vulgar, or otherwise offensive or violates our  Prohibited Items RegulationsCommunity Rules  or any part of our Terms. You also agree not to post any content that is false or misleading or use the Services in a fraudulent or misleading manner.

6. Your use of our Services

License to use our Services.  We grant you a limited, non-exclusive, non-transferable, revocable license to use our Services — subject to the Terms of Service, including the following restrictions  :

A. Don't use our Services to break the law.  You agree not to violate any law through your use of our Services. This includes all local, state, federal and international laws that may apply to you. For example, it is your responsibility to obtain any necessary permits or licenses for your store.  ; you can not  sell any item that violates any law  ; you must respect our  Sanctions Regulations  and must not commit fraud (including misrepresentation or notice of infringement), theft, engage in anti-competitive, threatening conduct, or engage in any other illegal acts or torts against Uvvar, another Uvvar user or a third party.

B. Pay your bills.  You are responsible for paying all fees owed by you to  Uvvar. Except as noted below, you are also fully responsible for collecting and/or paying any taxes applicable to any purchases or sales you make through our Services. For digital items sold to buyers residing in Australia, Belarus, European Union, Iceland, India, New Zealand, Norway, Russia, Serbia, South Africa, South Korea, Switzerland, Taiwan, Turkey or the United Arab Emirates , Uvvar will help collect and remit the correct amount of Value Added Tax or VAT. Some countries may use other terms  for VAT, for example GST (Goods and Services Tax), but we will refer to VAT, GST and any local sales taxes collectively as "  VAT  "). In addition, Uvvar will calculate, collect and remit sales tax where applicable. Your fees, bills, taxes and how you pay them are fully explained in our  Fees and Payments Regulations .

C. Do not steal our Content from us.  You agree not to explore, screenshot or use spider programs on the pages of the Services, or to reverse engineer them, or to attempt to obtain the source code of the Services. If you want to use our API, please follow our  API Terms of Use .

D. Do not attempt to harm our systems.  You agree not to attempt to disrupt or interfere with our Services, such as by spreading a virus or other harmful computer code.

E. Comply with our Trademark Policy.  The name "  Uvvar  and other Uvvar trademarks, phrases, logos, and designs that we use in connection with our Services, are trademarks, service marks, or trade dress of Uvvar in the United States, the DRC, and other other countries. If you wish to use our marks, please respect our  Trademark Regulations .

F. Share your ideas.  We love your suggestions and ideas  ! They can help us improve your experience and our Services. Any ideas or other unsolicited items you submit to Uvvar (not including Your Content or items you sell through our Services) are considered non-confidential and non-proprietary to you. You grant us a non-exclusive, worldwide, royalty-free, irrevocable, assignable, perpetual license to use and publish these Ideas and Articles for any purpose, without receiving any consideration.

G. Contact us online.  From time to time, Uvvar will provide you with certain legal information in writing. By using our Services, you agree to abide by our  Electronic Communications Policy , which describes how we provide this information to you. This policy indicates that we can send you information electronically (email for example) instead of sending you hard copies by post (preserve the environment), and that your electronic agreement has the same value as your signature on paper.

7. Termination

Termination by you.  We don't want you to leave us, but you can terminate your Uvvar account at any time from your account settings.

The termination of  your account will not affect the availability of certain Your Content that you posted through the Services prior to termination. One more thing, you will still have to pay all outstanding bills.

Termination by Uvvar.  We may terminate or suspend your account (and any related accounts) and your access to the Services at any time, for any reason,  and without prior notice. If so, it's important to understand that you have no contractual or legal right to continue using our Services, such as to sell or buy on our websites or mobile apps. Uvvar may deny access to the Service to anyone, at any time, for any reason.

If you or Uvvar terminate your account, you may lose all information associated with it, including Your Content.

We may interrupt the Services.  Uvvar reserves the right to modify, suspend or discontinue any of the Services at any time, for any reason. We will not be liable to you for the effect any changes to the Services may have on you, including your income or ability to generate income through the Services.

Survival.  The Terms will survive even after your access to the Service is terminated, or your use of the Service is terminated.

8. Warranties and limitation of liability (or what you cannot sue us for)

The items you buy.  You understand that Uvvar does not manufacture, stock or inspect items sold through our Services. We just provide the platform where transactions happen  ; the items listed on our marketplaces are produced, listed and sold directly by independent sellers, and therefore Uvvar cannot and does not guarantee their quality, safety or even their legality. Any legal action related to an item you purchase must be brought directly against the seller of the item. You release Uvvar from any liability  with respect to any claims related to items sold through our Services, including defective items, misleading information from sellers, or items causing bodily harm (such as product-related claims ).

The content you access.  You may come across articles that you find offensive or inappropriate when using our Services. We make no representations about any content posted by users through the Services. Uvvar is not responsible for the accuracy, copyright compliance, legality, or decency of user-posted content that you access through our Services. You release us from any liability related to such content.

The people you interact with.  You may use the Services to interact with other people, whether online or in person. However, you understand that we do not monitor all the actions of users of our Services, and you release us from any liability related to your interactions with other users. Be alert and exercise caution and good judgment when interacting with other people, especially if you meet someone in person. 

  Third Party Services.  Our Services may contain links to third-party websites or services that we do not own or control (for example, links to Facebook, Twitter, and Pinterest). You may also need to use a third-party product or service in order to use some of our Services (such as a compatible mobile device to use our mobile apps). When accessing such third-party services, you do so at your own risk. These third parties may require you to agree to their own terms of use. Uvvar is not a party to these agreements  ; these are entered into solely between you and the third party.

Gift cards and promotions.  You acknowledge that Uvvar provides no guarantee with respect to the balance of your gift card, and is not responsible for any access,  unauthorized modification, theft or destruction of a gift card or gift card code resulting from an action by you or a third party. You also acknowledge that we may suspend or prohibit the use of your gift card if it or its code has been reported as lost or stolen, or if we believe that your balance is being used in a suspicious, fraudulent or other unauthorized way. If your Gift Card code stops working, the only way for us to fix this is to issue a replacement code. By participating in a special offer or promotion, you agree that you cannot later claim that the rules of such special offer or promotion were ambiguous.

  guarantees.  uvvar  strives to make our services as best as possible, but we are not perfect and sometimes things can go wrong. you understand that our services are provided “  as is  and without warranty of any kind (express or implied). we expressly disclaim all warranties of title, non-infringement, merchantability, and fitness for a particular purpose, and all warranties implied by contract performance, course of business, or usage of trade .

We do not guarantee that  : (i) the Services will be secured or made available at any particular time or location  ; (ii) any defects or errors will be corrected  ; (iii) the Services will be free of viruses or other harmful materials  ; or that (iv) the results of using the Services will meet your expectations. You use the Services solely at your own risk. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not apply to you.

Limits of Liability. to the fullest extent permitted by law, neither Uvvar nor our employees or directors shall be liable to you for any lost profits or revenues, or for any consequential, incidental, indirect, special, or punitive damages. arising out of or in connection with the Services or these Terms. Uvvar's total liability for all damages shall in no event exceed the greater of one hundred (100) usd or the amount paid by you to Uvvar in the last twelve months. Some jurisdictions do not allow limitations on incidental or consequential damages, so the above limitations may not apply to you.

9. Compensation (or what happens if we are sued as a result of an action by you)

We hope that never happens, but if Uvvar is sued because of something you did, you agree to defend and indemnify us. This means that you will defend Uvvar (including any of our employees) and hold us harmless from any lawsuits or legal demands (including reasonable attorneys' fees) arising from your actions, your use (or misuse) of our Services, your violation of the Terms, or your violation of your account or the rights of others. 

We reserve the right to assume our legal defense in any way we deem appropriate, even if you indemnify us, in which case you agree to cooperate with us so that you can help us execute our strategy.

10. Disputes with other users

If you find yourself in a dispute with another user of the Uvvar Services or a third party, we encourage you to contact the other party and attempt to resolve the dispute amicably.

Dispute system.  Service owners, buyers, and sellers who are unable to resolve a dispute related to a transaction made on our websites or mobile applications can use our Dispute System. Uvvar will attempt to help you resolve disputes in good faith and solely based on our interpretation of our rules, at our sole discretion.  ; we will not make any judgments regarding lawsuits or legal matters. Uvvar is under no obligation to resolve disputes.

Release Uvvar from any liability.  You release Uvvar from any and all claims, demands, and damages arising out of disputes with other users or parties.

11. Disputes with Uvvar

If you are angry with us, let us know, and we hope we can resolve your issue. But if we cannot, then the following rules will govern any legal dispute involving our Services  :

A. Governing Law.  The Terms are governed by the laws in the matter, without regard to its conflict of laws rules, and by the law of the Democratic Republic of the Congo. These laws will apply no matter what country you are in, but if you live outside the DRC you may be able to benefit from the protection of the mandatory consumer protection provisions under your local protection laws. of the consumer.

B. Arbitration.  You and Uvvar agree that any dispute or claim arising out of or under these Terms shall be finally settled by arbitration, in  French language, in accordance with its arbitration rules for consumers (the "  AAA Rules  ”) in effect (these rules are deemed to be incorporated by reference into this article and, from the date of these Conditions), unless the law provides otherwise. Arbitration, including fundamental questions of the arbitrability of the dispute, will be decided by a single arbitrator, in accordance with these rules. Judgment on the arbitration award will be rendered in any court of competent jurisdiction. Any arbitration under the Terms will take place on an individual basis.  : Group arbitrations and class actions are not permitted. You understand that by agreeing to these Terms, you and Uvvar each waive the right to a jury trial or to participate in a class action or group arbitration. Notwithstanding the foregoing, each party shall have the right to bring an action in court in a court having proper jurisdiction for injunctive or other equitable or conservatory relief, pending a final determination by the arbitrator. You may, instead, present your complaint to the local court, but only if it qualifies, if it remains within the framework of this court and if it remains within an individual, non-representative and non-collective framework.

C. Arbitration Fees.  Payments of any reasonable filing of a claim with the competent judicial service,  administrative and arbitration fees will be determined under the Consumer Arbitration Rules. The Accuser will pay reasonable claim filing, administrative, and arbitrator fees associated with the arbitration, unless the arbitrator determines that the substance of your claim or the damages sought are superficial or required for an improper purpose.

D.Forum.  We are based in Kinshasa, so any legal action against Uvvar related to our Services must be brought and take place in the county of Kinshasa. For all actions brought under the AAA Rules, proceedings may be filed in your place of residence or in Kinshasa, and any in-person hearing will be held at a location convenient to both parties taking into account their ability to travel and other relevant circumstances. For all legal actions not subject to arbitration, you and Uvvar agree to submit to the personal jurisdiction of a state or federal court located in the county of Kinshasa,

E. Changes.  If we make any changes to the "  Disputes with Uvvar  after the date you accepted these Terms, such changes will not apply to any claims filed in legal proceedings against Uvvar before the date  when these changes take effect. Uvvar will notify you of substantial changes made to the section "  Disputes with Uvvar  » at least 30 days before the date on which these changes will take effect. If you do not agree with the changes made, you can send Uvvar written notice (including by email) or close your account during these 30 days. By rejecting a modified term or permanently closing your account, you agree to arbitrate any dispute between you and Uvvar according to the provisions of this section "  Disputes with Uvvar  from the last date you accepted these Terms, including any changes made prior to your rejection. If you reopen your closed account or create a new account, you agree to be bound by the then current version of these Terms.  

12. Changes to these Terms of Use

We may update these Terms from time to time. If we think the changes are material, be sure that we will let you know by posting those changes through the Services or by sending you an email or message about them. In this way, you can decide whether you want to continue using the Services. Changes will take effect when posted, unless otherwise specified. You are responsible for reviewing and becoming aware of any changes. Your use of the Services following the changes constitutes your acceptance of the updated Terms.

13. A few legal niceties

The Terms, including any regulations that make them up, supersede any other agreements between you and Uvvar regarding the Services. If any part of the Terms is found to be unenforceable, that part will be limited to the minimum extent necessary so that the Terms otherwise remain in full force and effect. Our non-enforcement of any part of the Terms does not constitute a waiver of our right to subsequently enforce that part or any other part of the Terms. We may assign any of our rights and obligations under the Terms.

We are happy to offer these rules in the language of your choice, but it is important to understand that the English version of this document controls and governs your use of the Uvvar services. You can change your language preference in your account settings.

Prohibited Items Policy

  Uvvar is not a marketplace whose articles have been selected. However, for various reasons, we prohibit certain types of articles on Uvvar. Some articles pose legal risks to our community, while others are inconsistent with our values, dangerous to our members, or simply not in the spirit of Uvvar. These rules explain what is prohibited or restricted on Uvvar. 

This regulation is part of our  Terms of Use . By opening a store or service on Uvvar, you agree to abide by these rules and our Terms of Service.

The following item types are prohibited or restricted on Uvvar  :

  1. Alcohol, tobacco, drug paraphernalia, and medications

  2. Animal products and human remains

  3. Dangerous items  : dangerous goods, recalled articles and weapons

  4. Hate Articles  : Articles that promote, support or glorify hatred

  5. Illegal items, items promoting illegal activities and heavily regulated items

  6. Internationally regulated items

  7. Pornography and explicit content

  8. Violent Articles  : articles that encourage, support or glorify violence

  9. Services or articles relating to fetishism,  occult practice and/or spiritualism

 

Defining a settlement is a complex matter. We consider many different and often conflicting factors before arriving at a decision on what is best for our community. Because we are a creative Christian community, we fight unemployment and poverty, and we value freedom of expression. We also tend to allow articles that have artistic, educational or historical value, but we know that even these articles are subject to a variety of valid and sometimes conflicting emotional responses and interpretations.

Art and history can be provocative, emotional, and divisive. There are topics on which we can never reach consensus as a community, and we accept that.

To help provide more clarity and perspective on our rule-making process, we have included the reasoning behind our decisions and details on how they will be applied, including below some representative examples of what which is permitted on the Uvvar site. We reserve the right to remove listings that we determine are not in the spirit of Uvvar. Violation of these Rules may result in the suspension and/or termination of the Member's selling privileges.

1. Alcohol, tobacco, drugs, drug paraphernalia and medications

Alcohol and drugs are prohibited on Uvvar. These substances are subject to severe legal restrictions and, in many cases, are considered controlled substances under applicable law. Our rules also apply to other substances which have or are supposed to have an intoxicating or healing effect. Apart from possible legal restrictions, these substances are simply not on Uvvar's mind.

Here are examples of items that cannot be listed on Uvvar  :

  1. Alcohol.

  2. Tobacco products, smokable products, e-cigarettes and e-liquids.

  3. Drugs and certain  herbal substances , including substances used for recreational and medicinal purposes, regardless of their legality.

  4. Equipment intended for drug use , including, for example, articles incorporating a carburetor  ; slide pipes and/or items with a slide  ; bongs and water pipes  ; and vaporizers and their components.

  5. Drugs, regulated medical devices and pharmaceuticals.

Restrictions on the description of the intended therapeutic effects  :

A therapeutic claim is a statement or suggestion that an item prevents, cures, or treats a medical condition or disease. Therapeutic claims are subject to varying degrees of legislation. If you are making claims about the intended therapeutic effects of an item for sale on Uvvar, we strongly recommend that you consult with a qualified expert in the field to determine which regulations apply to you. You are responsible for knowing and following all laws and regulations that apply to the items you sell.

In keeping with our values, Uvvar prohibits certain therapeutic claims such as claims that may mislead or pose an undue risk to our community. Uvvar may remove claims that we consider to be inappropriate or unsuitable for our selling platform. We also remove content promoting prohibited therapeutic claims, such as anti-vaccine articles. If we receive proper notice from a legal authority, we may remove an item or service.

Examples of what is allowed  :

Baked goods

Empty liquor bottles and related items Example  : Wine bottle tray

Resources  :  Help for small businesses provided by the Food & Drug Administration (FDA)  ;  FDA  and  FTC  in the United States for more information on therapeutic claims  ; 

2. Animal products and human remains

Certain animal products are highly regulated and prohibited on Uvvar due to the risk of harm to the lives of live, pet or endangered animals.

Additional details  :

Here are examples of animal products that cannot be listed on Uvvar  :

  1. Live animals (prohibited by law).

  2. Items created from threatened or endangered animal species. We define as threatened or endangered animal species those designated as such by the  DRC Endangered Species Act  or listed in the CITES (Convention on International Trade in Endangered Species) treaty.  Products based on the skins or parts of cats or dogs as defined in the  United States federal law .

  3. Ivory or bones of ivory-producing animals, including ivory tusks, elk ivory, fossilized ivory and woolly mammoth ivory.

  4. Items made from human remains or products derived from the human body.

Examples of what is allowed  :

Resources  :  Endangered Species Act  ;  Ban on the import of cat and dog fur

We expect all of our members to follow their local laws. If you are shipping items overseas, we also recommend that you review the treaty  CITES  (Convention on International Trade in Endangered Species of Wild Fauna and Flora  - Convention on International Trade in Endangered Species of Wild Fauna and Flora) for specific information on the import and export of endangered species. If you sell products containing feathers, consider also consulting the  Treatise on Migratory Birds .

3. Dangerous items  : dangerous goods, recalled articles and weapons

For legal and safety reasons, we prohibit certain dangerous items from our marketplace.

Dangerous products

Due to the potential harm caused by hazardous products, as well as the complex legal and transportation provisions surrounding them, hazardous products are prohibited on Uvvar.

Although the list is not exhaustive, the following items are examples of prohibited hazardous products  :

  1. Explosives (fireworks or sparklers)

  2. Explosive precursors

  3. Flammable items

  4. Gas

  5. Radioactive products

  6. Toxic substances (eg poisons)

Recalled Items  or items that present an unreasonable risk of harm

Items that have been recalled by governments or manufacturers are prohibited from sale on Uvvar. Certain vintage Corning Ware percolators, lawn darts and drop-side beds are examples of recalled items.

Items that pose an unreasonable risk of harm are prohibited, even if they have not been recalled. This includes, for example, items that pose a choking hazard. We generally rely on information from various government agencies to identify these items.

Weapons

Context is important when it comes to defining what does or does not constitute a weapon. If in doubt, it is safest to assume that we will not authorize an item intended to be used as a weapon to inflict injury. As a general rule, the following items are not allowed on Uvvar:

  1. Rifles, knives or other obvious weapons, even vintage.

  2. Dummy firearms  and weapons that appear real or are prohibited by law  law.

4. Hate Articles  : Articles that promote, support or glorify hatred

We want Uvvar to be a community where people of all backgrounds, nationalities, religions, political affiliations, and even with different types of humors and artistic tastes feel welcome. Art is incredibly subjective, and what's offensive to one person isn't necessarily offensive to another.

Uvvar does not allow articles, images, services or product listings that promote, support or glorify hatred towards people, or put people down on the basis of  such as race, ethnic origin, country of origin, religion, gender, gender identity, disability or sexual orientation (collectively, "  protected groups  "). We also prohibit articles or content promoting organizations or individuals expressing such views.

The following items are not allowed on Uvvar  :

  1. Items that support or commemorate current or historical hate groups, including collectibles or propaganda. Examples of hate propaganda groups include Nazi or neo-Nazi groups, Ku Klux Klan (KKK) groups, groups advocating homosexuality, lesbianism, pedophilia and/or white or black supremacy, misogynist groups or groups that advocate an anti-gay agenda, an anti-immigrant agenda, or a Holocaust denial agenda.

  2. Articles that contain racial slurs or derogatory terms, in reference to protected groups.

Examples of what is allowed  :

Some articles may contain symbols or terms associated with hate groups in a context unrelated to the group itself. We understand that these items are subject to a variety of valid and often contradictory interpretations of their educational, historical and artistic value. Recognizing that there may not be consensus on their value and reserving the right to evaluate these items on a case-by-case basis, the following types of items are generally permitted on Uvvar  :

A note on swastikas  :
We are sensitive to the fact that there are many cultures around the world that use the swastika for legitimate purposes completely unrelated to Nazism. However, since the Nazi swastika is widely recognized as a symbol of hate, we have decided to only allow swastikas when they fit into a clear religious or cultural context.

5. Illegal Items, Items Promoting Illegal Activities, and Highly Regulated Items

We follow the law and expect Uvvar sellers to follow it too.

Illegal items, items that promote illegal activities, and stolen items are not permitted on Uvvar. Likewise, items that are subject to complex registration systems or legal regulations are not permitted. As Uvvar is an international company, it is important to follow the laws of the markets in which you offer items for sale. What is legal in one country may be prohibited in another. All forms of illegal activity are strictly prohibited. The sheets produced must not allow or promote illegal acts. 

Counterfeit or unauthorized items are prohibited on Uvvar. We consider counterfeit or unauthorized items that imitate an authentic product, especially using a trademark name, logo or copyrighted design without the consent of the trademark owner. Replica luxury handbags and designer clothing are examples of prohibited counterfeit or unauthorized items.

Additionally, due to complex legal restrictions that vary by location, Uvvar requires members selling real estate or motor vehicles (e.g.  (cars, motorcycles, boats, travel trailers, etc.)  to follow all applicable laws for the items they offer for sale.  Native American craftsmanshipplants and seedschildren's products and  food products  are examples of items that may be subject to regulation.

6. Internationally Regulated Items

Uvvar connects buyers and sellers, service providers and their customers located anywhere in the world directly. If you buy or sell an item abroad, or if you start a transaction with someone residing beyond the borders of your country, it is your responsibility to respect the laws and regulations of the country of destination, as well than local laws.

When buying and selling internationally, you should follow local laws and be aware that other countries may have their own restrictions. Under international laws and regulations, the export or import of certain items may be prohibited. For some transactions, licenses, permits or other documents may be required. If you have any questions relating to compliance with the law, we recommend that you  consult an expert in the field.

When using Uvvar's services, you must also comply with economic sanctions as well as trade restrictions, including those imposed by the US Treasury Department's Office of Foreign Assets Control (OFAC). . All Uvvar members must respect our  Sanctions Regulations , regardless of their geographic location.

Uvvar reserves the right to request that sellers provide additional information, indicate the country of origin of an item in a listing, or take action to meet their compliance obligations. 

Please be aware that third-party payment processors, such as PayPal, may independently monitor transaction compliance and block certain transactions as part of their own compliance programs. Uvvar has no power or control over the independent decision-making of these providers.

Examples of what is allowed  :

Sanctions or compliance programs may include some exceptions in their restrictions. For example, while OFAC generally prohibits transactions involving products originating from sanctioned geographic areas, there are exceptions for information carriers such as publications, films, posters, phonograph recordings , photographs, tapes, CDs and certain works of art. Articles not originating from a sanctioned area but referring to such an area are generally permitted.

7. Pornography and Explicit Content

As a Christian community, we tend to be quite open about what we allow on Uvvar, but we say no to porn. Besides that, we apply restrictions on explicit content so that people who are offended by this type of content do not have to see it. If you sell explicit content, we ask that you respect the various sensitivities.

Pornography of any kind is prohibited on Uvvar, while explicit content is restricted.

Pornography can be difficult to define, but an article generally qualifies as pornographic when it contains an extreme or explicit version of sexual-type content.

We define explicit content as depictions of the human genitalia, sexual activity or content, foul language, sexual wellness articles, violent images (within reason  ; See as well  Violent Articles ), and explicit depictions or types of taxidermy.  Not all nudity is considered explicit, and examples are listed below. If you're wondering if your article is self-explanatory, it's probably reasonable to assume it is and label it as such.

In deciding whether explicit content crosses the threshold of pornography, we consider the degree of explicit depiction of the sexual activity or content.

8. Violent Articles  : Articles that encourage, support or glorify violence

We want Uvvar to be a place where everyone is safe. While violent content may be a legitimate part of historical, educational, or artistic expression, it should never be used to promote or glorify acts of violence against others.

We do not allow services, articles, or product listings that encourage, support, or glorify acts of violence or harm to self or others, including credible threats of harm.

The following items are not allowed on Uvvar  :

  1. Items that glorify human suffering or tragedies, including items that commemorate or honor serial killers

  2. Articles that attempt to exploit natural disasters or human tragedies

  3. Articles that encourage, glorify or celebrate acts of violence against individuals or groups

  4. Items that promote self-harm, undernourishment or other forms of self-destruction

Articles that show support or awareness for people at risk of self-harm, including people with eating disorders  Example  : Suicide Awareness Poster

Community rules

At Uvvar, community is at the heart of everything we do. Uvvar members use community spaces to inspire each other, share knowledge, brainstorm ideas, and bond. The Uvvar community includes the Dating Forums, the business area, Uva – maket, Uvvar voyage and the seller's or service provider's box (Service group and their customers).

 

This regulation is part of our  Terms of Use . By using any of Uvvar's community spaces, you agree to these rules and our Terms of Service.

1. Using the Uvvar community

The Uvvar community is a public feature through which members can communicate with each other. Members using Community Spaces must be  over 18 years old . In order for Uvvar to remain a safe and respectful business platform, you agree to observe the following rules in  all  community spaces  :

  1. Respect the  privacy  of other members. Do not share private or personally identifiable information in public areas of the site.

  2. Be honest and transparent about yourself. Do not use false identity.

  3. Show respect for other members. Do not use community spaces to publicly criticize a specific member, service, store or item.

  4. Do not use community tools or spaces to  to intervene  in another member's business.

  5. Do not send spam. This includes unsolicited or multiple copies of postings or links to your store or service, fundraisers, surveys, social media, or other promotional content.

  6. Do not use community spaces to discuss price coordination with other members.

  7. Do not use community spaces to harass other members. Likewise, do not post content in community spaces that is likely to promote, defend or glorify hatred.

  8. Do not post threats of violence against others or encourage others to use violence or engage in illegal activities.

  9. Do not engage in any activity that is illegal or violates any person's intellectual property, or encourage others to engage in such activities.

  10. Do not use community spaces to encourage others to violate Uvvar regulations.

Uvvar reserves the right to take action against any account or content that violates this policy. For example, we may remove your content, temporarily or permanently suspend your community posting privileges, or close your Uvvar account.

Below are additional rules that apply to you when using certain Community Spaces.

2. Business Dating Forums

The Forums are a public space where you can find other service providers, customers and other sellers to communicate about your Uvvar companies and business.

By using the Uvvar Dating Forums, you acknowledge that  :

  1. Your posts will stick to the topic discussed. Posts unrelated to the topic and case may be deleted.

  2. Your posts in the Forums are permanent in nature (unless removed by Uvvar for violating our policies).

  3. If they are meant to express disagreement or criticism, they should be constructive, encouraging and helpful. Avoid  harass , target, insult, troll or call out to other members.

  4. Moderators may need to take certain steps to ensure that the Forums remain welcoming, organized and helpful to everyone. These measures are not subject to discussion.

  5. Uvvar reserves the right to remove any inappropriate content from the Forums at any time.

3. Direct Messages

Members can communicate through direct messages using the community's built-in messaging system. These messages are different from Uvvar Messages, and can be accessed and read while in Community Spaces.

By using direct messages in the Uvvar community, you agree to all of the above rules. Also, you can't send messages  :

  1. abusive, threatening, defamatory, deemed harassing, or otherwise violates our  Non-Discrimination Policy  ;

  2. obscene or vulgar  ;

  3. unsolicited advertising or promotion  ;

4. Member Groups

You can connect with other Uvvar members who share similar interests to yours through member groups.

By using the Member Groups feature, you acknowledge that  :

  1. Uvvar has no responsibility or involvement in any group's rules, membership fees, finances or other actions.

  2. Groups that violate Uvvar's policies may be deleted, and Uvvar reserves the right to delete a group for any reason.

  3. Uvvar will not act as an arbitrator in disputes between groups and third parties, or between groups or members of a group.

  4. Uvvar will not exercise control over forums hosted by third parties or other independent sites operated by the groups.

  5. Any use of the term "  Uvvar  , other brands of Uvvar or similar brands must comply with the  Uvvar Trademark Policy .

  6. A group may not use obscene, profane or hateful language or images in its name, banner or logo.

  7. A group cannot be used for the sole purpose of redirecting the flow of users to another Internet location. Uvvar reserves the right to remove links posted on any profile page or group page for any reason. Unsolicited promotion or advertising by representatives or affiliates of third-party services, websites, or other products is not permitted.

  8. A group must have a captain  and may also include one or more leaders. The moderation of a group is the responsibility of its captain.

  9. The  group forums  are subject to these Community Guidelines and may not be used for purposes of protest or discussion regarding disputes between members or with Uvvar.

  10. A group may have a charter indicating its conditions of membership and its expectations. The team managing the group is responsible for the application of its charter. A group charter must comply with all Uvvar policies, including our  Terms of use  and our  Regulations concerning copyright and intellectual property .

  11. If a group chooses to use a specific tag for its members' listings (also called a "  group tag  "), this tag must contain the word "  band  ". Uvvar will not arbitrate disputes regarding the use of group tags on listings.

5. Uvvar Broker

  Uvvar broker  connects buyers with sellers, travelers and carriers, businesses and service seekers.  Uvvar who participates in fairs or markets in their region. Customers and buyers can shop in person from service provider vendors to support both the local economy and the Uvvar community.

For your event to be included in Uvvar broker, it must meet the following conditions  :

  • Take place in a physical location

  • Be open to the public

  • be limited in time

Here are some examples of events that can be promoted on Uvvar  :

  • Craft fairs

  • Markets

  • Pop-up or personal shops

  • Exceptional events

The following events cannot be included in Uvvar:

  • Online/virtual events

  • Galleries and art studios (unless your event takes place in a gallery or art studio)

  • Physical stores (unless your event takes place in a physical store, such as the “  Small Business Saturday  ")

We are happy to offer these rules in the language of your choice, but it is important to understand that the English version of this document controls and governs your use of the Uvvar services. You can change your language preference in your account settings.

 

Settlement against  discrimination and hate propaganda

Uvvar connects serious consumers around the world with creative entrepreneurs. It's an ecosystem where people from all walks of life inspire each other and build relationships by making, selling, and buying unique products. We want everyone who uses Uvvar to feel safe, and our priority is to develop an inclusive environment. This policy explains the type of behavior we prohibit on Uvvar to ensure that we all have a positive experience.

This regulation is part of our  Terms of Use . By using Uvvar, you signify your agreement to these Rules and our Terms of Use.

Uvvar prohibits the use of our Services to discriminate against individuals based on the following personal attributes (collectively, “  protected groups  ")  :

  • Race

  • Color

  • Ethnic group

  • National origin

  • Religion

  • Gender

  • gender identity

  • sexual orientation

  • Disability

  • Any other feature protected by applicable law

It is your responsibility to know your local laws as well as any other legal regulations regarding discrimination that may apply to you. Additionally, Uvvar does not allow hate speech. Hate speech occurs when violent, offensive, derogatory or degrading language is directed at a person or group based on one or more protected group attributes.

Whether you engage in public duties on Uvvar, such as  selling itemsuse of community spaces  and writing reviews, or that you  communicate directly with other members of the Uvvar community, for example via messages, discrimination and hate speech are not allowed. As a seller on Etsy, your shop content, including welcome messages and terms and conditions, may not display discriminatory behavior against protected groups. The following are, but not limited to, examples of prohibited conduct  :

  • Denial of service based on membership in one or more protected groups

  • Expressing intolerance or disrespect towards another member based on the attributes of a protected group

  • Have terms and conditions of sale that exclude sales to members of one or more protected groups listed above

  • Make directly or indirectly derogatory or demeaning remarks about the protected groups listed above

  • racial slurs

  • Posts that encourage or glorify existing hate propaganda groups and their members

If you think there has been discrimination or hate speech at Uvvar , please report it by emailing customerservice@uvvar.com, and we'll investigate. If you come across a product sheet that does not seem to respect our  Prohibited Items Regulations , including  hate articles  prohibited, we encourage you to  report the article  using the link  Report this article to Uvvar  by e-mail to serviceclient@uvvar.com . Trademark Regulations

Uvvar supports and promotes ideas, services and tools that use and complement Uvvar's services. At the same time, we value the protection of our reputation, brands and brand identity. This Trademark Policy explains how to refer to Uvvar, our marks or our services.

This regulation is part of our  Terms of Use . By using any of Uvvar's services, you agree to abide by these rules and our Terms of Service. This policy only covers use of Etsy's intellectual property (for example, use of the term "Uvvar"). For issues regarding any intellectual property not exclusively owned by Uvvar, please see the  Intellectual Property Regulations  of Uvvar.

What you need to know about the brand

A trademark is a word, name, symbol, or device (or a combination thereof) that identifies the goods or services of one person or company and distinguishes them from the goods and services of others. people. The word "Uvvar" and other Uvvar artwork, logos, design, page headers, button icons, scripts and service names (collectively, the "Uvvar Marks") are registered trademarks, or packaging from Uvvar.com., in the DRC and/or other countries.

Why Uvvar Must Protect the Marks of Uvvar.com  ? Uvvar shall be able to assure Internet users and others that only services offered, sponsored, or endorsed by Uvvar bear the Uvvar Marks. Trademark law not only requires that we implement protection against misuse of Uvvar's Marks, but also that we implement protection against the use of confusingly similar marks.  

Use of Uvvar Marks

Here are our rules for using Uvvar's Marks  :

We support and encourage the use of Uvvar's Marks in the following ways  :

  • Make fair use of the Marks of Uvvar. Uvvar supports free speech and you do not need permission to make legitimate comments about Uvvar, the company, or Uvvar's services. For example, if you sell on Uvvar, it helps to let people know.

  • Distinguish Marks of Uvvar from surrounding text, for example, by capitalizing the first letter of Marks of Uvvar.

  • Correctly spell the Marks of Uvvar.

We do not authorize the following uses of the Uvvar Marks  :

  • Incorporate a Uvvar Trademark or similar confusing mark into, for example, the name of your business, organization, non-profit organization, event, or brand.

  • Delete, alter, misrepresent or modify the Uvvar Marks, including adding other terms to the Uvvar Marks to create new words.

  • Use the Uvvar Trademarks or a confusingly similar mark in such a way as to falsely imply a relationship or affiliation with, or sponsorship or endorsement by, Uvvar. or can be reasonably interpreted to suggest that the information comes from, or represents the views or opinions of Uvvar, Inc. or an employee of Uvvar.

  • Use the Uvvar Marks in any product unless authorized in writing by us.

  • Use any trademarks, service marks, trade dress, designs or logos that are mistakenly similar to or suggestive of Uvvar's Marks or the aesthetics of Uvvar's website.

  • Use the Uvvar Marks in any way or on any website that contains or promotes adult content, gambling, or otherwise violates any applicable laws or regulations.

  • Use Uvvar's Marks in any way determined by Uvvar, in its sole discretion, to be misleading, unfair, defamatory, infringing, libelous, derogatory, incriminating, obscene or otherwise objectionable to Uvvar.

Fees and Payments Policy

Fees may be charged to sellers for the use of some of Uvvar's services. This Fees and Payments Policy explains your fees and taxes and how to pay them.

This regulation is part of our  Terms of Use . By opening a store on Uvvar, you agree to abide by these rules and our Terms of Service.

1. Types of fees

Sellers may be required to pay the following types of fees. Note that the charges shown do not include any Value Added Tax (VAT) that may apply. See the Taxes section below for more details.

Listing fees
Listing fee of 0.20  You will be charged USD for each item listed for sale on Uvvar.com through UVA - Market or Uvvar's mobile apps. For items that are already listed in your Uvvar store, there is no additional charge for listing on your store or business profile service. The product sheets that you offer only on your business profile are not subject to selling fees except in the case where you use the payment service of Uvvar, 5% of the displayed price will be retained. Listing fees are charged to you only when you create your account (business profile) on Uvvar  and this renewable annually; no costs for modifying a product sheet will be charged. You will be charged listing fees whether or not the item listed is sold on Uva - Market, unless you create a  private listing , in which case you will only be charged listing fees when that private listing is sold. Uvvar.com product listings expire after four months. Listings intended solely for the business profile never expire. If you list multiple copies of the same item, the original listing fee will be 0.20  USD, and the listing will automatically renew for 0.20  USD per unit sold. Listing fees are reflected in your payment account and deducted at the time the listing is published or renewed. Please note that listing fees are non-refundable. 
Transaction fees

When you make a sale on Uvvar.com, transaction fees  corresponding to 5  % of the price displayed for each product sheet as well as the amount you charge for delivery and gift wrapping are charged to you. If you use Uvvar Payments and list your items for sale in a currency other than the currency of your payment account, see the Currency Conversion section below for details on transaction fees. If you are based in R  ;D – Congo or Congo Brazza, the transaction fee does not apply to sales tax, goods and services tax (“  GST  "), or the Harmonized Sales Tax ("  HST  "), unless these costs are included in the price indicated on your product sheet. If you are based outside the DR - Congo and Congo Brazza, these transaction fees apply to the price indicated on the product page (which should include all applicable taxes), delivery costs and gift wrapping costs . If you offer optional customization for an additional fee, the additional customization fee is added to the price of the listing you view, and the total price displayed is subject to the same transaction fees described in this section. See the Taxes section later in this document for more details and whether you need to include applicable taxes in your listing prices. Transaction fees are deducted from your current balance each time a sale occurs, and are reflected in your payment account.

Costs of advertising and promotional offers

Uvvar offers several services to help you promote your listings and store, including Uvvar Advertising and Offsite Advertising. If we use Advertising on Uvvar for your product, Uvvar bills you at the end of the month according to the nature of the product, as described in detail below. Regarding Advertising  external, you are only charged a fee if the advertisement of your product sheet by Uvvar directly leads to a sale, as described in detail below. For more information, see the  Advertising and Marketing Regulations .

Uvvar Advertising Fees

If you buy paid ads on Uvvar through the Uvvar ads and document sales page to promote your listings or shop on the forum post. Maximum bill can be set from a minimum set by Uvvar. All bids are conducted in US Dollars (USD). Advertising fees on Uvvar are billed monthly, deducted from your current balance and reflected in your payment account. For more information, see the  Advertising and Marketing Regulations .

External Advertising Fees

Uvvar purchases advertising placements from several partners, including social networks and search engines. If your product page is part of these advertisements, a buyer clicks on it and then places one or more orders in your store within 30  days after that click, you will be charged advertising fees for those orders (which we will collectively refer to as "  Commands assigned  » and individually under the name of «  Order assigned  ").

The Offsite Advertising fee you will be charged for assigned Orders depends on the amount of sales your store has made during the past 365  previous days, as follows  :

  1. The standard commission is 10  % on assigned Orders, unless commission rate of 8  % only applies as described below.

  2. If your shop has achieved less than 10  000  USD of sales during the 365  previous days (dating back to 20  february  2021 and later), the sum being calculated on the first day of the month, you will pay a commission of 10  % (as described in the section below) on assigned Orders, unless you are not interested in participating in Offsite Advertising while your store is below the 10 threshold  000  USD informing us before. This commission of 10  % and the ability to opt out of Offsite Advertising apply until you reach the threshold of 10  000  USD, in the event that this occurs.

  3. If your shop has made at least 10  000  USD of sales during the 365  previous days (therefore going back to 26  february  2021 and later), the sum being calculated on the first day of the month, you will pay a commission of 8  % (as described in the section below) on Orders awarded from the start of the program if you are directly qualified or from the first day of the month following your qualification. If you subsequently fall below the threshold of 10  000  USD, the advertising commission you will be charged will remain at 8  %, for the lifetime of your store. If you deactivated your participation in Offsite Advertising before reaching the threshold of 10  000  USD, however, you will have to participate as soon as you reach this threshold, and an advertising commission of 8  % will be charged on assigned Orders for the life of your store. Cancellation of your participation in Offsite Advertising performed when your store was below the threshold of 10  000  USD will no longer apply (even if you subsequently fall below this threshold).

  4. One month after the first calculations made for the launch of the program, Uvvar will perform new calculations on the first day of each calendar month and will notify you if you have exceeded the threshold of 10  000  usd.

The calculation of sales for this threshold of 10  000  USD will be realized by multiplying the price of the items sold by their quantity (subtracting any discounts or officially canceled orders) and excluding business profile orders, in-person sales, Uvvar fees as well as delivery charges, taxes or gift wrap charged separately. For sellers whose default store currency is not USD, the threshold of 10  000  USD is calculated according to the conversion rates in effect on Uvvar at the time of each sale taken into account. The exchange rates used are variable. They are provided by a third-party financial services company. For more information on the calculation of the threshold of 10  000  USD, see the following section as well as the  Advertising and Marketing Regulations

The method of calculating the External Advertising commission  :

The Offsite Advertising fee applies to assigned Orders. It is invoiced as a percentage of the total amount of the order, i.e. the sum of the price displayed for each item sold, your delivery price, the price of any gift wrapping and, in some locations, taxes, as described below. The applicable commission rate of 8  % or 10  %, is determined as described above.

If you use Uvvar Payments and list your items for sale in a currency other than the currency of your payment account, see the Currency Conversion section below for details on Offsite Advertising fees. If you are selling from a country other than the DRC, the External Advertising fee will also apply to any taxes included in the price of your items. If you offer optional personalization for an additional fee, that additional fee is added to the price of the listing you are viewing, and the total price displayed is subject to the same Offsite Advertising fees described in this section. There is no limit to the number of Offsite Advertising commissions that can be charged on assigned Orders. However, the total External Advertising commission of the same order will not exceed 100  usd. Offsite Advertising fees are deducted from your current balance and reflected in your payment account.

Subscription fees

Uvvar sellers or Uvvar service providers who are in good standing can upgrade to Uvvar - Top, a subscription plan that offers a wider range of tools for growing brands. The price of subscription to Uvvar - Top is 10  USD per month. Uvvar - Top subscription fees are deducted from your current balance every month, and are reflected in your payment account. Where applicable, Uvvar will charge sales tax on the monthly subscription fee for sellers residing in the DRC.

Automatic renewal.  Subscription fees will be added to your payment account in your local currency on the same day every month. For example, if you register on the 5  March, your subscription fee will be added on March 5  April, 5  May, etc. If you sign up at the end of the month, your subscription fee will be added to your payment account on the last day of the month. For example, if you register on the 31  May, subscription fees will be added on 30  June because it is the last day of the month. You can cancel your Uvvar - Top subscription at any time by writing to us at servicecommercial@uvvar.com

You will have access to your Uvvar - Top subscription until the end of the subscription period, and you will be notified of your last day of access. Once the Uvvar - Top subscription ends, your store will revert to Uvvar Standard and subscription fees will no longer be added to your payment account.

In-person selling fee

You can use the  order form and more  to process payments for in-person sales. If you choose to synchronize your product sheets or your sales with our forms, those available in several quantities will be subject to the same renewal fee of 0.20  USD than those available in multiple quantities on Uvvar. In-person selling fees are deducted from your current balance and reflected in your Payment account. In-person sales processed with our forms will not be subject to the $5 transaction fee  % of Uvvar or the Uvvar Payment Processing Fee, but will be subject to  payment processing fees with order form and others. 

Payment processing fees

Online sales. Uvvar shops can use Uvvar  Payments to accept certain payments via Uvvar ( you will find more information at the member menu unclet customer guide). Uvvar charges payment processing fees for each transaction made through Uvvar  Payments. Payment processing fees vary depending on your bank account location. For certain markets, Uvvar may also charge a fixed fee on seller funds transfers that are below established thresholds. Payment processing fees are calculated on the total sale amount, including taxes and shipping. The payment processing fee is deducted from the sale amount in your payment account. Transfer fees are deducted from your available funds and appear in your payment account at the time the transfer is scheduled.

Shipping costs

Uvvar offers sellers based in certain countries the option of purchasing shipping labels to ship their orders. The cost of a shipping label depends on the carrier, origin, destination, package weight and dimensions. If you add delivery confirmation or insurance, these charges will be added to the total cost of the label at the time of purchase. Sellers who purchase shipping labels can also purchase package insurance through approved insurance companies. You must accept Uvvar  Payments or PayPal as payment methods to be able to purchase shipping labels through Uvvar. Shipping charges and any adjustments will be reflected in your payment account and deducted from your current balance. 

Full Boss Fees

You can try our full-boss solution for free, which will allow you to create a personalized store on Uvvar, for a period of 30  days. After the free trial period of 30  days, a monthly subscription fee of 10  USD will be charged to you. Where applicable, Uvvar will charge sales tax on the monthly subscription fee for sellers residing in the DRC. For the first month, your subscription fee will be pro-rated, then it will be applied in full for each subsequent month of full-boss usage.

Automatic renewal.  Your subscription fee will automatically renew on the first day of the month at 12:01 a.m. DRC time. You can interrupt your subscription at any time by writing to us at technique@uvvar.com  30 days before payment. If you discontinue service after your subscription renews on the first day of the month, you will be charged the full subscription fee for that month.

All Full-Boss fees are reflected in your payment account and deducted from your current balance.

Currency conversion

Except for Transaction Fees, Offsite Advertising Fees, Payment Processing Fees, and Wire Transfer Fees, Uvvar converts USD fees into the currency of your payment account based on the market rate at the time such fees are charged. are reflected in your payment account. All charges appear in your payment account in your local currency. Transaction Fees and External Advertising Fees  : if you list your items for sale in a currency other than US dollars, transaction fees and any External Advertising fees on the price displayed for each product sheet as well as on the amount you charge for shipping and gift wrap will be converted to US dollars at the market rate and reflected in your payment account.

To avoid exchange fees on your sales, Uvvar recommends that you list your items in the same currency as your payment account. Buyers see items in the currency of their choice. As a user   from Uvvar  Payments, if you decide to list in a currency other than that of your payment account, a currency conversion fee of 2.5  You will be charged % of the sale amount for transferring the funds to your payment account. Currency conversion is handled automatically by our payment processor and described in detail in our  Rules regarding Uvvar Payments .

2. Fee Bypass

Any action taken by a vendor or service provider to avoid paying fees is considered fee circumvention and is strictly prohibited by Uvvar. This includes, for example, encouraging buyers to purchase an item from your Uvvar store through another site. A transaction initiated on Uvvar cannot be finalized outside of Uvvar. The price displayed in each listing description should be an accurate representation of the sale. Sellers or service providers may not change the price of the item after a sale for the purpose of avoiding Uvvar's transaction fees, misrepresent the geographic location of the item, or use the account from another user without permission.

3. Payment of your Uvvar fees

Uvvar will automatically deduct any fees payable from your payment account. If you have sufficient funds in your payment account, no further action is required for payment. If your payment account does not have sufficient funds, the responsibility to pay the full fee payable within 15  days from the date of your monthly statement to you, or the account will be considered overdue, and Uvvar may charge the bank card linked to your account or take other action to obtain the funds, as described in Recovery of  Regulation regarding Uvvar  Payments . If you make a sale while in arrears, the net amount of the sale will be used to meet your outstanding balance. You can pay your outstanding balance manually by credit card, bank card or PayPal. Sellers residing in the DRC can also sign up for M-pesa billing, Orange Money and Uvvar's automatic balance due payment option.

Your statement is available in your email inbox at the beginning of each month and provides details of all sales and charge activity for the previous month.

Uvvar may suspend your selling privileges at any time pending payment of your outstanding balance.

Automatic invoicing (for sellers based in DRC and Congo Brazza)

When you enroll in Uvvar's automatic payment program (the "  automatic billing  ”), any fees payable that are not covered by the funds in your payment account will be charged to the credit card associated with your account on the first day of the month or when your current balance is greater than or equal to the fee threshold. . As part of the use of the program, you accept the following conditions.

A. You authorize Uvvar to store your payment card information and to debit that card, on the first day of each calendar month, for charges accrued during the previous month, and each time the charge balance reaches the threshold. appointed on your behalf. When you are registered, Uvvar will charge the amount of your current balance to the registered credit card.

B. When your card account is debited, Uvvar will send you an email indicating the amount charged. You can also view this information by accessing your account on Uvvar through my payments.

C. If the card account you registered with is closed, the account number changes, or an amount payable is rejected by your card issuer, you must update your card information or add a new number card to your Uvvar account. If your direct debit is declined by the issuer for any reason, your Uvvar account may be suspended or terminated, but you must still pay your balance owing by other means. Your authorization applies to any successor card to the current card or to any replacement card provided by you or your card issuer. 

D. You can cancel automatic billing and switch to manual payment by updating your payment settings in your Uvvar account. Uvvar needs a reasonable period to act after receiving your notification. This means that an additional automatic payment may be made to your card account while we process your application.

E. Suspended or terminated members remain liable to pay Uvvar all outstanding fees.

4. Uvvar Payments

Uvvar  Payments allows vendors and service providers to accept various forms of payment in US dollars when using Uvvar services.

Any seller or service provider on Uvvar is automatically registered with Uvvar  Payments. Vendors and suppliers using Uvvar  Payments are also subject to  Regulation regarding Uvvar  Payments .

5. Taxes

Except in the specific circumstances set forth below, you are responsible for collecting and paying all taxes associated with use of Uvvar's services and sales made through such services. Uvvar will provide notices to certain sellers to comply with IRS and state requirements.

A. List your items for sale on Uvvar

If you sell on Uvvar, applicable taxes must be included in the prices indicated on your product sheets. Note that some countries may use other terms for VAT, for example GST, but we will refer to VAT, GST and any local taxes collectively as "  VAT  unless the context requires otherwise.

Where Uvvar is responsible for collecting sales tax/VAT on your behalf, we will use the category you have assigned to each listing to calculate, collect and remit the applicable taxes. It is entirely your responsibility to ensure that your listings are categorized correctly, and you agree to indemnify Uvvar for all losses resulting from your misclassification of your listings. 

Note that Uvvar fees do not include any withholding taxes that may apply in your country. Payment of the full Uvvar fee is mandatory, and you are not allowed to deduct any withholding taxes. 

Also note that some countries require Uvvar to apply VAT on any fees that may be charged to you under this policy, and the fees described in this policy do not include such VAT.

B. Taxes on Seller Services
Sales tax on subscription fees

Where applicable, state sales tax will be applied to the Full - Boss Subscription Fee and Uvvar Subscription Fee  - Top charged by Uvvar.

VAT on seller fees

Depending on the status and location of your business, Uvvar may be required to apply VAT on the vendor fees invoiced monthly and remit it to the relevant tax authorities. VAT is charged on all Uvvar fees for sellers residing in countries where VAT must be applied.

C. Taxes we collect from buyers and remit on behalf of seller
VAT Charges on Digital Items

In accordance with the local laws of certain countries, Uvvar must collect and remit VAT to the relevant tax authorities when you sell a digital item delivered to the buyer by automatic download. Uvvar will automatically show the buyer the price increased by the amount of VAT to collect the correct amount, and remit this VAT to the tax authorities. If the sales were made through Uvvar  Payments, Uvvar will collect the VAT amount from the buyer and remit it to the relevant tax authority, so you will not have to take any special action. If the sale was not made through Uvvar  Payments, you will receive the additional amount paid by the buyer for VAT and you must remit this amount to Uvvar. The VAT amount paid by the buyer will appear in your payment account and will be deducted from your current balance.  

VAT collected on international sales to US and Australian buyers

In Australia and the United States, VAT is also called GST. Uvvar will automatically include GST on sales to Australian buyers from non-Australian or US sellers. Uvvar will be responsible for remitting it to the Australian Tax Office.

For orders placed through PayPal, Uvvar will send the GST collected to the seller as part of the payment. Uvvar will add the tax to the seller's Uvvar return so that we can remit it to the Australian or US authorities.

GST is not applicable if the total value of the package exceeds 1  000  AUD or if the transaction is between a buyer and a seller both in Australia and the United States. Sellers may need to add additional information on customs forms associated with these shipments.

 

Regulations concerning minors

Uvvar's Terms of Service require all account owners to be 18 years of age or older. The people of  under 18  years  are considered minors on Uvvar. Minors under 13  years  are not authorized  on Uvvar.

Minors under the age of 18 and 13 or older are permitted to use the Uvvar Services only if they have the proper authorization and direct supervision of the parent or legal guardian who owns the account. 

You are responsible for any activity performed by a minor on your account.

The following restrictions are in place for legal reasons, and not because we believe children or adolescents are less creative or competent.

Accounts on Uvvar

All minors aged 13 and over, both buyers and sellers, must follow these rules on Uvvar  :

  • Minors cannot make purchases unless they have proper authorization and are under the direct supervision of the parent or legal guardian who owns the account.

  • All financial information on the account, such as a credit card or PayPal account, must be that of the parent or legal guardian.

Sell on Uvvar

Minors aged 13 or over who wish to sell on Uvvar must adhere to the following additional regulations  :

  • Use section  In regards to  to disclose all store members, including the parent or legal guardian who owns the account.

  • All billing information must belong to the parent or legal guardian responsible for the account.

  • Yes  Payments  is used, the parent or legal guardian must register with their information.

Intellectual Property Regulations

As a platform for artists, creators, writers, artisans and others, Uvvar takes intellectual property rights very seriously. We follow intellectual property laws and industry best practices to maintain the integrity of our creative and business marketplace. This Intellectual Property Policy explains how we handle claims of infringement, how authorized parties can submit formal notices of infringement regarding content on our marketplace or service, and how Uvvar sellers can respond when their product sheets or their shops are the subject of an opinion.

1. Role of Uvvar

Uvvar is a place of business made up of service owners and individual third-party sellers who each operate their own stores, set their own policies, and are responsible for their inventory and shipping, and for complying with the law. We provide a marketplace and business, but Uvvar does not manufacture products, handle inventory, or ship items on behalf of our sellers. Content uploaded to the Uvvar Marketplace is generated by independent sellers who are not employees, agents or representatives of Uvvar. Sellers must ensure that they have all necessary rights for their content and that they do not infringe or violate the rights of third parties by posting such content.

Uvvar reserves the right to disable any listing, store, service, or account that we believe violates our  Terms of Use , including this  Intellectual Property Regulations  or our  Prohibited Items Regulations . Uvvar also reserves the right to take action against anyone who violates Uvvar's Intellectual Property Policy or our Terms of Use.

Uvvar cannot speak on behalf of intellectual property owners, and is unable to offer legal advice or make legal determinations regarding a store's breach of intellectual property. other person. Uvvar will remove materials flagged as potentially infringing intellectual property when proper notice is provided. 

2. Notice of Intellectual Property Infringement

Uvvar endeavors to respond promptly upon proper receipt of a notice of intellectual property infringement addressed to servicelegal@uvvar.com by removing or disabling access to the item alleged to be infringing. When Uvvar removes or disables access in response to a notice, Uvvar makes reasonable attempts to contact the affected member, provide information about the notice and removal and, in cases of alleged violation of copyright, to provide information about the counter notice. Uvvar may also provide a copy of the notice of infringement, including the name and email address of the person responsible for the allegation, to the affected member.  

Uvvar may request additional information before processing a notice, such as verification of the identity of the person making the allegation or documentation regarding the right in question. Uvvar may reject notices or counter notices containing information that we believe to be false, fraudulent, incomplete, or otherwise submitted in bad faith. Uvvar also reserves the right to take action against anyone who violates this policy.

3. Notice of Dispute

In accordance with the Digital Millennium Copyright Act (DMCA), Uvvar accepts counter notices only regarding copyright notices. When 'Uvvar receives a DMCA counter notice, we will provide a copy of the counter notice to the original complaining party. The deleted article can be replaced or  access to it may be restored 10 days after the counter notice is processed, unless the copyright holder takes legal action against the alleged infringing party and notifies Uvvar of such legal action.

4. Repeated offenses

Uvvar revokes the selling privileges of Members subject to repeated or multiple notices of intellectual property infringement in appropriate circumstances and at Uvvar's discretion. If we believe a member has attempted to open a new store after the original account was revoked, we reserve the right to refuse all services to that member. These measures apply to any accounts that we believe are associated with or managed by the member concerned. In accordance with our  Terms of Service , Uvvar reserves the right to terminate account privileges at any time, for any reason and without notice.  

5. Infringement Notice Withdrawals

Uvvar only accepts notice withdrawals directly from the intellectual property owner, or their authorized representative, who submitted the claim. The takedown must clearly state regarding the official takedown of an allegation, and provide sufficient information identifying the member and/or the content concerned (for example, by providing the user name, the name of the store and the URLs of the files Uvvar products).

Upon Uvvar's receipt of an official takedown of a Notice of Infringement, Uvvar will make reasonable efforts to contact both parties involved to confirm receipt with the party submitting the takedown and to notify the affected Member of the withdrawal. Please note that intellectual property infringement issues are reviewed on a case-by-case basis, and a withdrawal of an allegation does not guarantee a change in the status of a member's store.
